(for The Be There Group, including Be There Psychology, Be There App, and Be There Foundation)

1. Introduction
Welcome to The Be There Group. These Terms of Service (“Terms”) govern your access to and use of our services, programs, websites, digital platforms, and resources. By engaging with us, you agree to these Terms.
The Be There Group operates through three streams:
Be There Psychology – professional psychology, mediation, and assessment services.
Be There App – a digital bystander support and resource tool.
Be There Foundation – a not-for-profit entity currently seeking full charity status, supporting prevention initiatives and victim-survivor support.
2. Eligibility
You must be at least 18 years of age to use our services, unless engaging in youth-specific programs with parental/guardian consent.
By using our services, you confirm you have the legal capacity to agree to these Terms.
3. Services Provided
Be There Psychology provides evidence-based psychological support, assessments, and mediation under Australian professional standards.
Be There App provides educational content, bystander tools, and resources to empower safe interventions and support. The App does not provide crisis counselling or emergency response.
Be There Foundation delivers prevention initiatives, resources, and community support projects.
4. Not a Crisis Service
Neither The Be There Group nor the Be There App provide emergency or crisis intervention. If you or someone else is in immediate danger, call 000 in Australia or your local emergency service.
5. Privacy and Confidentiality
We are committed to protecting your privacy in line with the Australian Privacy Principles (APPs).
Personal information shared with Be There Psychology is kept confidential and managed in compliance with AHPRA standards and applicable laws.
Data collected through the Be There App is anonymised where possible and not shared without consent, except where legally required.
The Be There Foundation will not share donor or supporter details with third parties, except as required for receipting, reporting, or compliance.
6. Fees and Donations
Fees for Be There Psychology services will be agreed in advance and invoiced in accordance with professional practice standards.
Donations to the Be There Foundation are voluntary. While we are currently a not-for-profit, we are in the process of securing charity and DGR status. Until confirmed, donations may not be tax-deductible.
Use of the Be There App is generally free; however, some premium features may be subject to fees, which will be clearly disclosed.
7. Intellectual Property
All content, materials, logos, frameworks, and resources provided by The Be There Group remain our intellectual property.
You may use our materials for personal or organisational purposes where permission is given, but you must not copy, reproduce, or distribute without prior written consent.
8. Appropriate Use
You agree not to misuse any Be There service, including attempting to gain unauthorised access to systems, spreading harmful content, or using resources to cause harm.
The Be There App is for educational and supportive purposes only and must not be used as a substitute for professional or medical advice.
9. Limitation of Liability
While we take care in providing our services, The Be There Group is not liable for any loss, injury, or damages arising from use of our programs, the App, or resources.
Professional services delivered through Be There Psychology are covered by appropriate professional indemnity and public liability insurance.
10. Third-Party Links and Services
Our websites, App, or programs may contain links to third-party websites or services. We are not responsible for the content or practices of these external providers.
11. Amendments
We may update these Terms from time to time. Continued use of our services after updates are published constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the jurisdiction of the Queensland courts.
